What happens if your rental is contaminated with meth in New Zealand?

Since 16 April 2026, a New Zealand rental is contaminated when any part of it has meth residue above 15 micrograms per 100 square centimetres, and uninhabitable above 30 (Tenancy Services; regulations in force 16 April 2026). The landlord must clean it to 15 or below whether or not the property is insured. Landlord insurance only helps if the policy has a specific meth benefit, and even then the claim conditions are strict. What the levels mean in practice

The Residential Tenancies (Managing Methamphetamine Contamination) Regulations 2026 sit under the Residential Tenancies Act 1986. Testing and clean-up follow New Zealand Standard 8510:2017 as modified by the regulations (Tenancy Services). Each part of the house is judged on its own, so one bad room matters even if the rest is clean.

Landlords must not knowingly rent out a contaminated property and must decontaminate it first (Tenancy Services). Tenancy Services says renting one out may also breach the Building Act 2004 and the Health Act 1956.

When you have to test

You do not have to test between tenancies, though you can. Detailed testing becomes mandatory in two situations: the Police or the council tells you meth was likely manufactured at the property, or a valid screening assessment shows at least one area above 15 µg/100 cm2 and you become aware of it (Tenancy Services).

If you test during a tenancy, you must give notice before entering and pass the results to the tenants within 7 days. Landlords who fail these duties may face exemplary damages of up to $7,200, and in some cases pecuniary penalties of up to $50,000 (Tenancy Services).

A cheap screening test before a new tenancy is worth considering for a practical reason. Tenancy Services notes that in a Tribunal dispute a party may need to show whether the premises were contaminated before the tenancy started (Tenancy Services). A dated result from before move-in is that evidence, and it also tells you what the house looked like when your insurer's cover began.

A worked example

Say you rent out a three-bedroom house and your property manager arranges a screening assessment with an approved method after a neighbour complains. It shows 8 µg/100 cm2 in the bedrooms and 22 µg/100 cm2 in the lounge. Under the tenancy rules the lounge is contaminated but the house is not uninhabitable, so detailed testing is now mandatory, the lounge must be decontaminated and a qualified professional, not the cleaner, must retest it. The tenants do not have to move out (Tenancy Services).

If the lounge had read 35 µg/100 cm2, the house would be uninhabitable and either side could end the tenancy on short notice (Tenancy Services). Whether your insurer pays anything towards either scenario depends on the policy, covered next.

Cleaning up and finishing the job

You can decontaminate yourself or hire someone, following section 4 of NZS 8510:2017 as modified. Carpets, curtains and other soft furnishings you supplied must be HEPA-vacuumed and steam cleaned if they can be saved, and replaced if they cannot. A qualified professional then tests again. If anything is still above 15 µg/100 cm2, you repeat the clean and the test (Tenancy Services).

Tenancy Services suggests agreeing any relocation and rent reduction in writing. If a part of the house is above 30 µg/100 cm2, a landlord who is not at fault can give 7 days' notice and a tenant can give 2 days' notice. If only a remote and inconsequential area is affected, rent must reduce and neither side can end the tenancy straight away (Tenancy Services).

What a tenant can be made to pay

Tenants must not use, sell or make meth. Tenancy Services says tenants who cause contamination breach the rule against intentional or careless damage and can be liable for damage caused by their guests. The Tenancy Tribunal can order damages of up to $1,800 against a tenant who used the property for an unlawful purpose (Tenancy Services).

That is small next to a clean-up bill, and recovering money from a tenant who has left is hard. Separately, for careless damage a tenant's liability is capped at four weeks' rent or the insurance excess, whichever is lower (Tenancy Services).

What a landlord policy pays

Tower's Landlord's Plus wording excludes pollution or contamination from controlled drugs except under its meth benefit, so meth cover is a specific benefit rather than a given. It is a useful example because Tower publishes the wording in full (Landlord's Plus wording).

Two points here catch landlords out. First, the benefit is not limited to meth labs: the wording also names consumption and use. Second, both loss of rent benefits say they do not apply if the house is uninhabitable because of contamination damage, so rent lost during a meth clean-up is not covered under this wording.

The conditions attached to a claim

A claim can fail on any of these:

  1. The house must be rented to a tenant when the contamination occurs, so contamination found in a vacant house is not covered by this benefit.
  2. The contamination damage must have first occurred while you were insured with Tower, and not under an earlier policy that had no meth benefit.
  3. You must make a formal complaint to the Police about the manufacture, storage, consumption, use or distribution of meth at the house.
  4. You and anyone managing the house must have met the policy's landlord obligations, which include getting references for adult tenants, a signed tenancy agreement, a documented pre-tenancy inspection, rent and bond totalling four weeks, and an inspection at least every three months. Tower may decline a claim and recover a payment if they were not met.
  5. After a payout, the meth benefit stops until an approved contractor certifies the house as remediated to NZS 8510 levels.

One more point deserves a question to the insurer. The wording defines contamination by the acceptable levels in the latest version of NZS 8510, while the tenancy rules now use the 15 µg/100 cm2 level set by the regulations. Whichever insurer you use, ask how its policy treats the two and whether an earlier test result affects a claim.

What level of meth contamination is unsafe in NZ?

Under the tenancy rules a property is contaminated above 15 µg/100 cm2 and uninhabitable above 30 µg/100 cm2. Tenancy Services says the lower level is based on a 2018 report suggesting that exposure below it is unlikely to cause adverse effects (Tenancy Services).

Does landlord insurance cover meth contamination?
