Letters of administration in New Zealand: when, who and what it costs
Letters of administration are a High Court order that gives a person, the administrator, authority to manage and distribute an estate when someone has died without a will, or when the will's named executors cannot or will not act. The court fee is $275. Many banks, savings providers and insurers may release funds without a court order if the total they hold is under $40,000, so small estates may not need letters at all (Ministry of Justice: Probate; Applying for probate, a practical guide, figures as at 20 October 2026).

Which court order applies when?
| Situation | Court order |
|---|---|
| There is a valid will and a named executor can and will act | Probate |
| There is a will, but no executor can act (for example, died or unwilling) | Letters of administration with will annexed |
| There is no will | Letters of administration |

When do you need them rather than nothing at all?
The $15,000 figure that appears in many summaries is not the rule for estates in general. The Ministry of Justice says an application to the High Court is usually required if the estate includes land or a house, is worth more than $40,000, or includes bonds or shares worth more than $15,000. Otherwise:
- Many banks, savings providers and insurers may release funds without a court order if the total value they hold is under $40,000 per institution. The payer chooses; it does not have to.
- The $40,000 limit (the "prescribed amount", raised from $15,000 from 24 September 2025) applies to each payer, not to the whole estate, and land is excluded. The $15,000 limit remains for government and local authority stock and company shares (Administration Act 1969, s65, as amended by SL 2025/158; Community Law).
- Joint bank accounts and property held as joint tenants usually pass to the survivor without a court order, but the ownership still has to be recorded.
- Banks can release funds for funeral costs without probate or letters (govt.nz).
- A life insurer may pay sums due to the administrator up to $40,000 without a grant. Asteron Life's claims page, for example, asks for letters of administration if the insured was sole owner and there was no will (Asteron Life: Claims).
Who can apply?
The administrator is usually the closest relative, or sometimes a trustee company or Public Trust (Community Law). Public Trust says the applicant must show the High Court they are entitled to administer the estate, and may need written agreement from others with an equal or greater right to apply. We did not find a plain-language source listing the full order of priority, so we do not print a ranking table; a lawyer will confirm who has the right in your family. Do not confuse this with who inherits, which is set out below.
What are the steps?
- Confirm there is no will and no executor who can act. Search as in how to find a will.
- Agree who will apply. Get written agreement from relatives with an equal or greater right.
- Get help to prepare the application. The Ministry of Justice calls these applications complex and its do-it-yourself guide does not cover them. It lists Community Law, Citizens Advice, the Law Society's Find a Lawyer tool and trust companies as places to start.
- File in Wellington. All probate and administration applications go to the Wellington High Court by post, in person or through the Ministry's File and Pay online system. The fee is $275 including GST, and a Registrar can waive, postpone or refund it.
- Wait for the grant. govt.nz says it "usually takes 6 to 8 weeks to get probate or a letter of administration, during busy times, it may take longer." The Ministry of Justice says applying for letters of administration is "generally more complex" than probate and gives no timeframe for it. We would not promise a date.
- Administer the estate. Public Trust describes the administrator's role as collecting assets, paying debts and distributing the estate according to New Zealand law.
What do letters of administration cost?
The court fee is $275. For the lawyer, we found one firm's published prices. PK Law lists, excluding GST:
| Application | Price | Notes |
|---|---|---|
| Letters of administration, complexity 1 | $3,300 | Family agrees who applies; disbursements extra |
| Complexity 2 | From $4,500 | For example, disagreement about who applies, or a party withholding consent |
| Complexity 3 | From $7,000 | Likely to be contested, for example a caveat against the grant |
| Independent advice on the notice of choice of option | $1,500 | Needed if a spouse is applying; charged separately |
Disbursements listed for complexity 1 include a will search ($86.25) and, for a male deceased, a Status of Children search ($35.70). PK Law's filing-fee line is out of date (the current fee is $275). The page is undated, retrieved 20 October 2026 (PK Law: Pricing). At the 15% GST rate, $3,300 is about $3,795. This is one firm's price list, not a market average. Public Trust says its fees are "based on the work we do, not the value of the estate" and it gives an estimate at the start. For probate fees side by side, see probate lawyer fees in NZ.
Who inherits when there is no will?
The administrator distributes under the Administration Act, s77. Public Trust's summary:
| Who survives | Who gets what |
|---|---|
| Partner only | Everything goes to the partner |
| Partner and children | Partner: personal effects, $155,000 plus interest from the date of death, and one third of the rest. Children share the other two thirds |
| Partner and parents, no children | Partner: personal effects, $155,000 plus interest, and two thirds of the rest. Parents share the final third |
| Children only | Children share equally |
| Parents only | Parents share equally |
| Siblings only | Siblings share |
| No eligible relatives | After a genealogist's search, the estate goes to the Crown; people who think they should have benefited can apply to the Treasury |
A de facto partner in a relationship of short duration (under 3 years, or longer if a court thinks it just) is excluded unless a court finds a child of the relationship or a substantial contribution and serious injustice (Administration Act, s77B; Property (Relationships) Act, s2E). Stepchildren are not named in s77, but a stepchild the deceased maintained can claim under the Family Protection Act. See dying without a will for the detail and contesting a will for time limits: a Family Protection Act claim must be made within 12 months of the grant.
Where life insurance fits
A life insurance payout is estate property only if it is payable to the estate; who is paid otherwise depends on who owns the policy and the insurer's terms (see who gets your life insurance payout). If you are weighing cover of your own later, the buttons on this page lead to Momentum Life's online quotes. Momentum's Quick Life takes ages 18 to 65 with no health questions but excludes pre-existing conditions and suicide for 2 years; its Funeral Insurance takes ages 40 to 75 and, for the first 24 months, pays only for accidental death. Total premiums can end up larger than the benefit. Momentum Life Limited is rated B (Fair) by A.M. Best (Momentum Life: Financial strength). Our funeral insurance guide has the age limits and alternatives.
Adviser's view
Letters of administration are the court's permission to deal with an estate when there is no will, or none of the executors named can act. The $275 court fee is the small part. The Ministry of Justice treats these applications as complex and does not cover them in its do-it-yourself guide, so most families pay a lawyer or trust company, and prices climb quickly once relatives disagree.
