A car claim in New Zealand can be declined when the loss falls under an exclusion, when the driver or the use of the car breaks a rule in the wording, or when the policyholder has not met a duty such as reporting a modification. Tower's comprehensive wording sets these out on pages 15 to 20 (Tower comprehensive wording). Other insurers' wordings differ in detail. This page is factual information, not advice on any claim.

Who was driving, and in what state
Tower's wording excludes a claim if the person driving or in charge of the car was over the alcohol limit, impaired by drugs, unlicensed, or failed to stop or give a required test. The full list is on page 15 (Tower comprehensive wording, page 15).

- A blood or breath alcohol level over the legal limit.
- A later conviction for an alcohol or drug offence connected with driving or being in charge of the car.
- Intoxicating substances or drugs, "prescribed or not", that caused or contributed to the loss.
- Not stopping at, or leaving, the scene of an accident when that is an offence.
- Failing or refusing a lawfully required blood or breath specimen.
- No legal licence to drive in New Zealand, or not complying with the licence conditions.
These exclusions do not apply if the person in charge of the car has stolen it. Tower's car page says it covers drivers on a learner or restricted licence while they drive inside the conditions of that licence (Tower car insurance page). How the car was being used
Tower's comprehensive wording covers the car only while it is used for social, domestic or private purposes, which includes community or charity work and getting to and from work. Business use, racing, off-road driving and unsafe driving are excluded (Tower comprehensive wording, pages 8, 16 and 17).

Rideshare is the use most readers ask about. Tower's car page says neither its private nor its commercial policies cover rideshare and carshare services such as Uber, Ola, Zoomy and Yourdrive. It also says private policies cover driving to work but not using the car for work (Tower car insurance page).
Things the policy never covers
Some losses sit outside comprehensive cover whatever the circumstances: modifications, tyres, personal effects, wear and tear, mechanical failure, fines, criminal acts and a few named events. The list is on pages 8 and 15 to 18 (Tower comprehensive wording).

- Modifications that differ from the manufacturer's specification, unless you chose the accessories and modifications benefit and Tower listed them on your certificate (pages 8 and 16). See modified car insurance.
- Tyres, unless the loss was malicious or happened alongside other accepted loss to the car (page 8).
- Personal effects and business tools left in the car (page 8).
- Wear, tear and depreciation, although resulting damage flowing directly from them is covered, and mechanical failure unless it results from a loss Tower has accepted (page 17).
- Fines, penalties and punitive damages, and criminal or reckless acts other than by a person who stole the car (page 16).
- A 72-hour stand-down for storm, flood, wildfire, tsunami, volcanic activity or landslide after the policy start date, and cyclones named before it (page 16).
- Another insurer's cover for the same loss, where Tower says it will not contribute (page 8).
- Personal injury covered under the Accident Compensation Act 2001 (page 15). See ACC and private insurance.
Duties that can cost you a claim
If a policy duty is not met, Tower's wording says it can decline a claim, recover any payment already made, and cancel or avoid the policy. The duties are on page 19 (Tower comprehensive wording, pages 19 and 20).

- Statements at application, during the policy and in a claim must be honest, correct and complete.
- The car must be kept in a roadworthy condition that would pass a Warrant of Fitness test.
- Tower must be told immediately if the car starts being used for business, is modified, or has a new regular driver.
- Tower must be told immediately about criminal or driving offences, licence suspensions or new licence conditions, and declined claims or refused insurance.
- The car must be locked, with any alarm or immobiliser on, when unattended.
- Premiums must be paid in full by the due date, and Tower may cancel if one is 28 days overdue.
At claim time, pages 21 and 22 add steps: get Tower's permission before arranging repairs, return any claim form within 30 days, let Tower inspect the car, and take reasonable steps to prevent further loss. Does the level of cover change the list?
The exclusions are near-identical across Tower's three car wordings, but the page numbers differ because the documents differ in length. What changes between levels is what the policy pays for, not the exclusions on top (Tower comprehensive wording).

If your claim is declined
Tower's wording says that if it declines a claim it will clearly explain why (Tower comprehensive wording, page 22). The Insurance Council of NZ says the first step is a complaint to the insurer. An external dispute resolution scheme is free to the insurer's customers if it is not resolved (ICNZ: making a complaint).

For a car quote you will need your registration number and the driver history for everyone who will drive the car, including any licence conditions. Why was my car insurance claim declined in New Zealand?
The reason will normally sit in an exclusion, a driver or use the wording excludes, or a duty that was not met. Tower's wording says it will clearly explain a declined claim, so the reason can be compared with the exclusions and responsibilities sections (Tower comprehensive wording, page 22).
Will car insurance pay out if I was drink driving?
Not under Tower's wording. The policy does not cover you if the person in charge of the car has a blood or breath alcohol level above the legal limit, or is later convicted of an alcohol or drug offence connected with the driving (Tower comprehensive wording, page 15).
Am I covered if I drive for Uber or deliver food?
Tower says its private and commercial car policies do not cover rideshare or carshare services such as Uber (Tower car insurance page). Delivering food, people or packages is a use that must be reported to Tower immediately (Tower comprehensive wording, page 19).
Is a mechanical breakdown covered?
No. Tower's car page says its policies do not cover a car that stops working because of mechanical failure, though roadside assistance can be added (Tower car insurance page). The wording excepts failure resulting from a loss Tower has accepted.
